User
A person or an entity who uses services in accordance with the Agreement signed with the service provider.
Active User
A person or an entity who has one or more active services.
Inactive User
A person or an entity without any services or whose services are cancelled or terminated.
Visitor
A person or an entity browsing the Provider's website at https://hostingwalay.pk.
Services
Either or both services and products provided by the Provider and available via the Provider's website.
Downtime
A period of time when a service is inactive or inaccessible.
Monthly Services
Services that are applied instantly or provided for a 1-month period.
Long-Term Services
Services that are provided for more than a 1-month period.
Primary Language
English.
Secondary Languages
Urdu.
Primary Currency
PKR (Pakistani Rupee).
Secondary Currencies
USD.
Billing Cycle
A predefined interval of time between two recurring payments.
Billing Account
The account at https://hostingwalay.pk holding a summary of all types of services provided to the User. Also entitled as Client Area.
Credit Balance
The amount of funds in the User's account.
Confirmed Affiliate Income
The amount of money that the User earned through the Affiliate System.
Reseller
A person or an entity who is accepted to the HostingWalay Reseller Program and gets access to the services and benefits of the program.
Affiliate Earned Funds
The amount of money that the User received.
Complaining Party
The User or an interested 3rd party that submits a report concerning the violation of the Acceptable Use Policy.
Authorized Payments
Automatic transactions that are pre-approved by the User.

1 Application of Terms

1.1

This Acceptable Use Policy (AUP) regulates the conditions and procedures for service provision by HostingWalay to its Users. By using our services, the User agrees to comply with this AUP in addition to the Terms of Service and Privacy Policy.

1.2

This AUP regulates the rights and commitments of both the Provider and the User in relation to permitted and prohibited uses of HostingWalay services.

1.3

The AUP takes effect upon website use or electronic acceptance date during account registration.

1.4

Singular words include plural and vice versa; natural persons also indicate legal persons.

1.5

Article names are for convenience only and don't influence interpretation.

2 Prohibited Uses

2.1

Services may be used for lawful purposes only. Users are prohibited from transmitting any material that violates international, national, or local regulations — in particular, the laws of the Islamic Republic of Pakistan.

2.2

Prohibited uses include (but are not limited to):

  • Fraud — financial scams, identity theft, fake billing, social-engineering schemes
  • Spam — unsolicited bulk email, comment spam, forum spam, SMS spam
  • Torrent — serving or sharing files using the torrent protocol on shared/VPS infrastructure
  • Scamming / phishing — fraudulent websites impersonating banks, brands, government bodies, or any third party
  • Cryptocurrency mining — mining of Bitcoin, Ethereum, Monero, or any cryptocurrency on any hosting plan
  • Malicious usage — activity that disturbs server work, neighboring users, or backbone networks
  • Abusive actions — targeting servers, users, or third-party services with brute-force, port scanning, exploit testing
  • DDoS & flooding — originating DDoS attacks, SYN floods, UDP floods, ICMP floods, or any other flooding
  • Proxy / VPN abuse — running anonymous proxies, Tor exit nodes, or VPN services designed to evade lawful authority
  • Malware / botnets — hosting or distributing malware, ransomware, RATs, trojans, viruses, or command-and-control servers
2.3

The Provider reserves the right to refuse service for any prohibited use violating these Terms, incompatible with our policies, or deemed illegal, harmful, or threatening — with or without prior notice.

2.4

Continued use for prohibited purposes triggers "User non-compliance" terms; the Provider may suspend or terminate the affected service and the Billing Account.

3 Anti-Spam Policy

3.1

The Provider does not tolerate spam. The spreading of spam through HostingWalay's network, servers, or services is strictly forbidden.

3.2

Users undertake the following obligations when using HostingWalay services for email or mailing:

  • Not to email people who haven't requested emails
  • Not to provide services that enable 3rd parties to spread spam
  • Implement technical means preventing 3rd-party spam (SPF, DKIM, DMARC records)
  • Apply the opt-in principle for electronic communication and offer effective means for opt-out / unsubscribe
  • Not to collect, store, publish, or spread data enabling spam (email lists scraped without consent)
  • Not to create open relays, easily exploitable mailing systems, or insecure mail submission endpoints
3.3

Non-compliance triggers "User non-compliance" terms; the Provider may suspend or terminate service with or without notice.

3.4

Users accused of spam who claim recipient consent must provide proof: logs containing recipient email, subscription date/time, and the IP address used to subscribe.

3.5

Refusal to cooperate with a spam investigation results in determination of guilt for policy violation.

4 Unlimited Resources Policy

4.1

Shared hosting and reseller hosting services are designed for small-to-medium personal, business, and organizational websites. Resources are limited to active email, web files, and website content directly serving a primary website.

4.2

Shared hosting resources cannot be used for:

  • File sharing — hosting files for download by anonymous or large audiences
  • Extensive storage of video, photo, log files, or software archives unrelated to the website's purpose
  • Document or archive storage — Dropbox-style cloud storage
  • Backup storage — using shared hosting as an off-site backup target
  • Websites whose primary purpose is driving traffic to other websites (link farms, doorway pages)
  • Operating high-traffic streaming or torrent trackers
4.3

The Provider does not limit disk space numerically but applies limited iNode resources per plan to ensure fair use.

4.4

Disk space and bandwidth usage is "unlimited" only if compliant with this AUP and Terms of Service.

4.5

Usage presenting risk to data storage, networking, stability, security, performance, or uptime of other services or users results in suspension or migration to a higher plan.

5.1

Users are prohibited from any actions opposing legal acts or violating 3rd-party rights, including storing, publishing, sending, distributing, or transferring prohibited, limited, threatening, discriminative, or infringing content.

5.2

User content must not oppose:

  • Pakistan legal acts (PECA 2016, Copyright Ordinance 1962, and related laws)
  • Regulations of the service location (datacenter jurisdiction)
  • Applicable third-party regulations (registry, registrar, payment-gateway terms)
  • International copyright treaties (Berne Convention, WIPO, etc.)
5.3

Copyright holders or third parties may report unauthorized copyrighted material uploads via our Report Submission page.

5.4

The Provider reserves the right to suspend or terminate services for reasonably suspected copyright infringement following a valid DMCA-style notice.

6 Unacceptable Material

6.1

The Provider does not tolerate unacceptable material, including (but not limited to):

  • Gambling websites — online casinos, betting platforms, lottery sites (irrespective of jurisdiction)
  • Websites promoting illegal activities — drug trade, weapons sales, human trafficking
  • Child pornography (CSAM) — zero tolerance, immediate suspension and report to FIA / authorities
  • Racist content — hate speech, discriminatory material based on ethnicity, religion, or background
  • Incitement of strife, hatred, or violence against any individual or group
  • Other abusive, defamatory, harassing, or threatening websites
  • Content that violates Islamic Republic of Pakistan blasphemy, defamation, or PECA regulations
6.2

The Provider reserves the right to refuse service for material violating these Terms, incompatible with our policies, or deemed illegal, harmful, or threatening.

6.3

Storing unacceptable material triggers "User non-compliance" terms; the Provider may suspend or terminate service with or without notice.

CSAM & serious offenses

HostingWalay maintains zero tolerance for child sexual abuse material and is obligated to report any such discovery to the FIA Cyber Crime Wing and applicable international authorities immediately, with full cooperation and preservation of evidence.

7 Unacceptable Resource Usage

7.1

Over-usage and malicious usage of server resources is strictly prohibited.

7.2

The Provider reserves the right to take action against a User's VPS or hosting account when activity (e.g., incoming DDoS) affects neighboring users or backbone networks.

7.3

Actions taken against containers under DDoS, scanning, or similar threats may include:

  • Suspension of the affected service
  • Null-routing of the affected IP address
  • Connection restrictions (rate-limiting, port blocking)
  • Migration to mitigated network segments
7.4

Common industry techniques and tools are used to restore service-neighborhood balance as necessary.

7.5

Users agree that such service outage caused by external malicious activity or by emergency mitigation actions is not considered downtime for SLA-credit purposes.

8 Enforcement & Reporting

8.1

The Provider investigates all reports of AUP violations submitted via the Report Submission page. Valid complaints with sufficient evidence are actioned within 24–72 hours depending on severity.

8.2

Severity levels and typical responses:

  • Critical (CSAM, active DDoS, ongoing fraud) — immediate suspension, evidence preservation, authority notification
  • High (phishing, malware, illegal content) — suspension within 24 hours; user given 7 days to remediate or face termination
  • Medium (resource abuse, spam, copyright) — warning issued; remediation deadline of 7–14 days
  • Low (minor policy breaches) — advisory email; persistent issues escalated
8.3

The Provider's decision on AUP enforcement is final but subject to good-faith review upon User appeal via support ticket within 30 days of action.
